FCC’s New Equipment Authorization Procedures and US Agent Requirements

Effective February 06, 2023, the Federal Communications Commission (FCC) has adopted FCC 22-84 on Protecting Against National Security Threats to the Communications Supply Chain through the Equipment Authorization Program.

Apart from new attestation statements to be submitted together with your FCC filing, a designation of a US Agent for Service of Record will be required from this new procedure update. Regardless of whether the applicant is a domestic or foreign entity, the FCC now requires them to designate a contact based in the United States to act as their agent for service of process.

The designated US Agent must have a physical presence in the United States and be duly authorized to receive legal notifications and official documents on behalf of the manufacturer or importer. The primary responsibility of the US Agent is to handle all communications with the FCC, ensuring that the company remains compliant with the FCC rules and regulations.

Companies seeking FCC ID and FCC SDOC (Suppliers Declaration of Conformity) will be required to comply with these updated procedures and appoint a designated US Agent to represent them.
