Vietnam’s MIC Issues Temporary Suspension of Key Technical Regulations for 5G and Wireless Technologies

On September 5, 2023, the Ministry of Information and Communications of Vietnam (MIC) issued Announcement No. 10/2023/TT-BTTTT, temporarily suspending the implementation of several QCVN technical regulations (in part or in whole) applicable to 5G, Wi-Fi, NFC, wireless charging devices, certain maritime equipment, and other categories of devices. This suspension is aimed at removing obstacles to the implementation of qualified certification, qualified declaration, and product quality inspection, as stated in Announcement No. 04/2023/TT-BTTTT.

Key points of the announcement include:

  1. Suspension of QCVN Standards for 5G Devices:
    • Full suspension of the implementation of QCVN standards for 5G terminal equipment and 5G smartphones, including QCVN 127:2021/BTTTT, QCVN 129:2021/BTTTT, and QCVN 18:2022/BTTTT, until December 31, 2023.
  2. Suspension of Specific Standards under Extreme Testing Conditions:
    • Suspension of standards such as QCVN 117:2020/BTTTT (2/3/4G), QCVN 54:2020/BTTTT (Bluetooth/Wi-Fi 2.4G), and QCVN 65:2021/BTTTT (Wi-Fi 5G) under extreme testing conditions, until December 31, 2023.
  3. Suspension of NFC Standards:
    • Suspension of NFC (QCVN 55:2011/BTTTT) technical requirements under extreme testing conditions until June 30, 2024.
  4. Suspension of QCVN Standard for 76-77GHz Automotive Radar:
    • Full suspension of the implementation of the QCVN 124:2021/BTTTT standard for 76-77GHz automotive radar until June 30, 2024.

During the suspension period:

  • The announcement (No. 10/2023/TT-BTTTT) is effective from the signing date and applies to products that have undergone quality inspection registration from July 15, 2023, to the present but have not completed the type approval certificate and qualified declaration procedures.

End of the suspension period:

  • If products have not passed all applicable technical regulations’ certification or declaration of qualification, businesses must undergo supplementary certification, declaration of qualification, or re-certification.
  • If products have been approved and qualified according to Announcement No. 04/2023/TT-BTTTT (complete testing and certification of technical regulations, including testing under critical conditions), the qualification certificate or notification will remain valid until the expiration date specified on the certificate.
